Investigation Boot Camp: Workplace Misconduct

An alarming number of organizations understand their duty to investigate harassment complaints, but have no plan for investigating other types of misconduct like theft, fraud, vandalism, workplace substance use, social media abuse, safety risks, violations of company policy, etc.

Imagine, for example, that you suspect misuse of company property by an employee. You work with the employees’ manager to investigate and confirm egregious violations. You terminate the employee.

How can you be sure your investigation is documented well enough to support the termination if the employee sues for retaliation or discrimination?

Do you know how to perform and document a search of the employee’s desk, computer, cell phone or locker?

Do you know if/when to involve law enforcement or external experts?

And because so many managers are oblivious to the risks of conducting investigations, can you even say for certain that every one of the supervisors at your organization knows to involve HR before they begin to look into claims or suspicions of misconduct?

To keep your company out of court, and make sure you have air-tight documentation if you DO get hit with litigation, this 2-hour intensive training course will teach HR professionals and supervisors best practices for fair, compliant and properly-documented investigations that decrease exposure to liability.

You’ll learn techniques for planning an investigation, interviewing witnesses, collecting and documenting evidence, producing a final report, and more.

LEARNING OBJECTIVES

After attending this session, you will know how to:

  • Determine if an investigation is necessary, if formal or informal techniques should be used, and who should be involved
  • Interview all involved parties in a way that solicits reliable information, even from unwilling participants. 
  • Properly document the investigation process
  • Perform workplace searches in a legally safe way
  • Determine and document the credibility of each person involved 
  • Reach an impartial conclusion based on the evidence gathered
  • Select the appropriate action based on the results of the investigation
  • Write a formal, legally sound final report

                            ABOUT THE SPEAKER

                            Dr. Susan Strauss is a nationally recognized expert, speaker, author, educator and consultant on management and organization development. She provides training on a variety of management and organizational issues, coaches managers and employees, assesses the workplace climate and provides a variety of interventions to enhance productivity and employee engagement. Her clients are from business, education, healthcare, law, and government organizations from both the public and private sector. Susan is a registered nurse, has a bachelor’s degree in psychology and counseling, a master’s degree in community health, and a doctorate in organizational leadership.
