OSHA Recordkeeping: What’s Recordable, What’s Reportable

Dealing with OSHA recordkeeping regulations is a reality of the job for many safety and HR professionals. The price of getting it wrong is high. Even simple errors can prompt OSHA to start auditing your facility, issuing fines or identifying your company as an “egregious” violator.

This presentation will address what you really need to know about OSHA recordkeeping and reporting regulations, including OSHA 300/301 logs, and other mandatory reports. You’ll discover how to maintain records in a way that will minimize legal liability and help you comply with regulatory requirements. You’ll also learn about OSHA’s new “immediate reporting” requirement for hospitalizations, amputations and eye loss accidents.

This program is intended for anyone who touches the OSHA record keeping process—including HR professionals, safety managers, and supervisors responsible for recording and reporting employee injuries.

Adele Abrams, Esq. – a nationally recognized expert on safety law – will outline document retention requirements for a host of OSHA standards, describe document destruction policies that are effective, and explain the distinctions between documents that must be produced during inspections and those that can only be required by subpoena or through litigation discovery.

Participants will get sound legal advice on issues including:

  • Distinctions between immediately reportable incidents and those that must simply be logged
  • How reporting and recording requirements vary based on where an injury occurs
  • How long mandatory records must be maintained
  • If and when disciplinary records must be shared with OSHA

                            Adele L. Abrams, Esq., CSMP, is nationally recognized as a leading authority on occupational and mine safety and health. She has led hundreds of accident investigations, conducts safety audits and training, and represents employers in OSHA and MSHA litigation. Ms. Abrams is a frequent author on safety, health and legal compliance issues. She also co-authored several books including the widely reviewed "Construction Safety Management and Engineering" textbook and the “Safety Professional’s Handbook.” Ms. Abrams is a regular presenter at prestigious safety conferences like the American Society of Safety Engineers (ASSE), where she specializes in providing real-world solutions to real-world problems.
